1Purpose and scope of License conditions

  1. The Real Deal Bridge (RDB) client software that you have downloaded or are about to download from this website (the “Software”) is being licensed to you by RDB for your private personal use solely on an “AS IS” basis.

  2. The right to use the software is non-transferable and on the condition that it is exclusively used for personal use and entertainment. RDB can withdraw the license if the conditions set out below are not complied with.
     

2User account

  1. To use RDB you will first need to create an account. 

  2. You may only have one RDB User account.

  3. You must use your real or commonly known first and surname for your account.  This information will be visible to other RDB Users.

  4. When creating an account, you are strongly encouraged to upload a profile photo which is an accurate and true representation of yourself.  This image is visible to other RDB Users and will ideally be a head shot with a smile.

  5. When generating your account, you should include your ABF number if you have one.

  6. All RDB accounts are created with an automatic registration to the RDB Bridge Club. 

  7. Memberships to additional bridge clubs are subject to approval of the participating Licensed Clubs.
     

3Games and Participation

  1. RDB and RDB Licensed Clubs have the right to restrict entries to sessions except for where such restrictions constitute illegal discrimination.

  2. You may only play in one session at a time on one instance of the program.
     

4Licensed clubs

  1. An RDB Licensed Club is an entity which holds a license to operate a club and conduct sessions on the RDB platform.  

  2. Your membership to a to any RDB Licensed Club is at the sole discretion of the Club Owner and subject to their terms and conditions.

  3. When participating in a Licensed Club game You are subject to their game structure, charge, terms and bridge playing facilitation. 

  4. Licensed Clubs are responsible for conducting and directing their own sessions through RDB.

  5. Licensed Clubs are responsible for the conduct of their staff and application of the Laws of bridge.  

  6. Licensed Clubs will have access to your registration details including but not limited to first name, surname, Australian Bridge Federation number (if supplied) and email address.
     

5Cost of use

  1. There is no charge for downloading RDB.

  2. There is no charge for the license to use RDB.

  3. Sessions on RDB may cost Credits.  Credits can be purchased (see 6).

  4. Additional expenses including but not limited to telephone, internet and computer or table equipment such as speakers are of your own expense.  
     

6Real Deal Credits “Credits”

  1. You may purchase Credits to be used on RDB for a fee.  Credits may be purchased from within the Real Deal Bridge app.

  2. Credits are not refundable, nor can they be withdrawn as cash or transferred to another User.

  3. In the event of User death remaining Credits are forfeited.

  4. Credits are forfeited when a User account is cancelled by the User or the User account is deleted due to inactivity for 2 consecutive years.

  5. A suspended User will retain their Credits however the account will be considered as inactive for the suspension period.

  6. Where a User is banned for life all remaining Credits are forfeited.

  7. Credits may be exchanged for entry into specific sessions.  The Credits required for this will be displayed on the appropriate session registration screen. 

  8. When you register for a session the Credits required for that game will be frozen. 

  9. You may not register for a session that you do not have enough Credits to play in.

  10. Credits for sessions are deducted from your account when the session commences.
     

7Prohibited uses

  1. UNDER-AGE PLAY IS PROHIBITED. No one under the age of 13 may use the Software in any way.

  2. The use of any external tool that provides an unfair advantage to the User is strictly prohibited.
     

8Governing Law

  1. It is prohibited to break any local, regional, national or international Law or rule of treaty consciously or subconsciously.
     

9Limitation of liability

  1. Under no circumstances, including negligence, shall RDB be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use (or misuse) of the Software, the Games or your accessing the Site or the Servers, even if RDB had prior knowledge of the possibility of such damages.
     

10Laws of Duplicate Bridge

  1. The 2017 Laws of duplicate bridge apply in any RDB session except for where RDB exercises its rights as the regulating authority.  A copy of the Laws of Duplicate Bridge 2017 can be found at http://www.worldbridge.org/wp-content/uploads/2017/03/2017LawsofDuplicateBridge-nohighlights.pdf

  2. User conduct and etiquette requirements include but are not limited to those outlined in Law 74.
     

11User conduct and behaviour

  1. The respect of human rights and dignity is a fundamental requirement during all activities on RDB.

  2. Discrimination of any kind is not permitted. Examples include but are not limited to discrimination based on race, gender, religion, sexual orientation, ethnicity, philosophical or political belief or family status.

  3. Physical, moral, professional or sexual harassment is prohibited and will not be tolerated.

  4. Any violation of the physical or intellectual integrity of another User is prohibited.

12User Generated Content

  1. Abusive or offensive language or other behaviour considered inappropriate by RDB in the context of the product will not be tolerated. Bad behaviour or language identified by RDB or reported to RDB will be reviewed within 48 hours and may result in a suspension or loss of playing privileges or such other action as may be decided by RDB.

  2. Any controversy or dispute among any Users or between one or more Users and RDB shall be settled by RDB whose decision shall be final and binding in all respects. RDB requires that all controversies or disputes be reported by email to report@realdealbridge.com

  3. Use of an inappropriate profile photo can result in a ban from using RDB.  Photos must not be defamatory, explicit, obscene, threatening, offensive or contain images of anyone under the age of 13.  Examples of inappropriate photos or pictures include but are not limited to images of offensive gestures and nudity. 

  4. You alone are liable for all communication and other activities carried out under your User account.

  5. During play all Users may only converse in English unless both captains (in team games) or all four Users at the table (in pairs events) agree to use some other common language at their own risk.

  6. Unless specified by the regulating authority (the session owner) all communication with Tournament directors will be in English.

  7. All communication to RDB will be English, and any costs for translation or interpretation will be assumed by the party wishing to communicate in a language other than English.
     

13Moderation Procedures

  1. Violations of these terms of service can be reported through RDB or by sending an email to report@realdealbridge.com

  2. Users have the ability to block another Users ‘User generated’ content. 

  3. Violations of these terms can result in removal of a User’s rights to use RDB temporarily or permanently.

  4. Minor violations of these terms as determined by RDB or Club Users will result in a warning.

  5. Violations of these terms which impact on another User’s enjoyment of the game can result in a suspension of a User account.

  6. A Users account will be disabled pending further investigation for violations of these terms which contravene another Users’ human rights or constitute cheating at bridge such as violations of Law 73B. 

  7. Where an investigation is required it will be conducted by RDB or their nominated agent.
     

14Temporary and permanent removal of a User from RDB

  1. RDB administrators have the right to temporarily or permanently ban a User account and remove Users from a game at any time.

  2. Where a User is banned from RDB all remaining Credits are forfeited.

  3. Club Users and administrators have the right to remove a User from a game.

  4. Where a User is removed from a game by an administrator or Licensed Club, Credits paid for that game are non-refundable.
